Consultation RE Governing Body Endorsement Requirements Criteria 2018

As the official Governing Body of Kabbadi in the United Kingdom EKF is required by the Home Office to consult all interested parties on it's proposed new Governing Body Endorsement Requirements Criteria. As part of this consultation the EKF would welcome all constructive comments on its proposed new criteria for the coming year. Section 1: 

Overview of governing body endorsements for the Tier 5 (Temporary Worker) Creative and Sporting category of the points-based system

This page provides a brief explanation of the endorsement requirements a sport governing body has agreed UK sponsors of the Tier 5 (Temporary Worker) Creative and Sporting category of the points-based system must show. 

The Tier 5 (Temporary Worker) Creative and Sporting category is for sportspeople (and their entourage where appropriate) and coaches who are internationally established at the highest level in their sport, and or will make a significant contribution to the development of their sport in the UK.

Sport governing body is one recognised by the one of the home country sports councils like Sport England. Every governing body must be approved by the Home Office before they are included in Appendix M of the Immigration Rules.

The application process explained: migrants applying to come to the UK under either of the sporting categories above need to be sponsored by an organisation that has a sponsor licence under Tier 5 (Temporary Worker) Creative and Sporting.

If you wish to sponsor such migrants, you must have a sponsor licence. Before you apply to the Home Office for a licence you must be endorsed by the governing body for your sport. This endorsement confirms to the Home Office that the application for a licence is from a genuine sports club (or equivalent) that has a legitimate requirement to bring migrants to the UK as sportspeople. Once licensed, you can assign certificates of sponsorship to a sportsperson or coach with a job offer that allows them to apply for leave to enter or remain in the UK. Each individual must also have a personal endorsement from the governing body for their sport before you assign the certificate of sponsorship.

The list of governing bodies and the tiers for which they are currently approved by the Home Office is in Appendix M of the Immigration Rules.

Approved governing bodies will work within the Home Office code of practice for sports governing bodies and must comply with any immigration regulations, UK legislation and the principles of the Points Based System as detailed on the GOV.UK website.

Length of endorsement

Governing body endorsements should be issued for a period appropriate to the period of approval for sponsorship or the tier under which the migrant’s application is being made, that is:

For the length of the contract or up to a maximum of 12 months, whichever is the shorter period.

 

Change of employment 

If a migrant is intending to change employer, their new employer must request a new governing body endorsement. The endorsement can be issued for the length of the contract or to the maximum period permitted within the category, whichever is the shorter. The new employer must assign a new certificate of sponsorship to the migrant to allow them to apply to the Home Office for new leave to remain. Leave to remain must be granted before the migrant can start work with the new employer.

Salary

The salary should be agreed as part of the contract between the migrant and the sponsor. This and the other conditions of employment should be at least equal to those normally given to a resident worker for the type of work undertaken. 

Supplementary Employment

Migrants are eligible to undertake supplementary employment under the Home Office supplementary employment regulations. The supplementary employment section of the Tiers 2 & 5: guidance for sponsors has more information on this.

Requirements

This page explains the England Kabaddi Federation (EKF) requirements under the Tier 5 (Temporary Worker) Creative and Sporting category for the 2018 season. The endorsements apply to England, Scotland, Wales and Northern Ireland.

Consultation

The following requirements have been agreed by the Home Office following consultation with the EKF and United Kingdom Kabaddi Federation.

Review

The requirements will be reviewed yearly in January.

Length of season

The playing season in the UK generally runs from May to August of each year. This may vary slightly from season to season depending on the arrangement of the first and last matches.

Initial and extension applications:

Governing body endorsements will be available for a player if the player:-

  1. Has represented his/her country at the Circle Style Kabaddi World Cup held by the Government of Punjab in India within the previous 3 years; OR
  2. Is a returning player who played 75% of games during the last three seasons whilst in the UK on a Tier 5 (Temporary Worker Creative and Sporting visa only; OR
  3. Is endorsed as being a kabaddi player of the highest calibre in his sport in India by Punjab Kabaddi Association which is a member of the Amateur Kabaddi Federation of India (AKFI) full details of which are available at http://www.indiankabaddi.org/about-us/members

In addition the club must:

  • have a written contract of employment with the player and provide evidence of the same to the EKF
  • provide on letter headed paper a guarantee duly signed by the senior officials of the club confirming that they will ensure that the player concerned will leave the UK before their current entry clearance or leave to remain expires

Dispute handling procedures

The EKF will settle and answer all queries, disputes or questions raised by clubs concerning theKabaddi game or sponsorship of players, coaches or managers in a good manner as required by the Home Office under the points-based system criteria.

The EKF as a governing body will make sure that all applications for endorsements are given fair and transparent consideration.  Any application will only be refused if it fails to meet any of the following:-

  • all the requirements of the Home Office points-based system Tier 5 (Temporary Worker) Creative and Sporting policy
  • the criteria contained herein

 

In the event of an application being refused the EKF will give the reason for refusal in writing to the concerned party. The EKF will keep copies of all correspondence conducted with the concerned party so that it may be made available to the Home Office if requested.

If an applicant for endorsement whose application has been refused wishes to challenge a decision on an endorsement, the EKF will deal with the same in accordance with its Disciplinary and the Resolution of Disputes Policy as contained in the EKF’s constitution a copy of which is available free of charge on request. 

If this does not resolve the issue between the parties with respect to the construction or effect of the rights duties or obligations of the parties under this criteria or as to any other matters in any way arising out of or in connection with this criteria then the matter in dispute must be determined by a single arbitrator appointed by agreement between the parties or in default of agreement within l4 days of one party giving notice to the other of his nomination appointed by the President for the time being of the Law Society of England & Wales or any person authorised by the President to make appointments on his behalf, on the application of either party in accordance with the Arbitration Act l996.

ਉਪਰਲੇ ਸ਼ਹਿਰਾਂ ਦੀਆਂ ਬਣੀਆਂ ਸਾਂਝੀਆਂ ਟੀਮਾਂ ਵਿਚ ਚੜ੍ਹਦੇ ਅਤੇ ਲਹਿੰਦੇ ਪੰਜਾਬ ਦੇ ਚੋਟੀ ਦੇ ਕਬੱਡੀ ਖਿਡਾਰੀ ਨੇ ਪਹਿਲੇ ਟੂਰਨਾਮੈਂਟ ਵਿਚ ਹੀ ਦਰਸ਼ਕਾਂ ਦਾ ਮਨ ਮੋਹ ਲਿਆ ਹੈ ਜਿਨ੍ਹਾਂ ਵਿਚ ਭਾਰਤ ਦੀ ਕਬੱਡੀ ਟੀਮ ਦਾ ਕਪਤਾਨ ਸੁਖਬੀਰ ਸਭਰਾਵਾਂ, ਗੁਲਜ਼ਾਰ, ਬਲਕਾਰਾ, ਸੁੱਖਾ ਭੰਡਾਂਲ, ਗੁਰਲਾਲ, ਗੋਗੋ ਰੂੜਕੀ, ਮਨਜੋਤ, ਚਿਸ਼ਤੀ, ਜਾਨੀ ਸੁਨਿਆਰਾ ਸ਼ਾਮਿਲ ਹਨ l

 

ਕੁਝ ਖਾਸ ਗੱਲਾਂ ਜੋ ਧਿਆਨਯੋਗ ਹਨ:
(1) ਇਹ ਟੂਰਨਾਮੈਂਟ ਇੰਗਲੈਂਡ ਕਬੱਡੀ ਫੈਡਰੇਸ਼ਨ ਦੇ ਸਹਿਯੋਗ ਅਤੇ ਅਸੂਲਾਂ ਮੁਤਾਬਕ ਕਰਵਾਈਆਂ ਜਾ ਰਿਹਾ ਹੈ l

(2) ਸ਼ਰਾਬ ਲਿਆਉਣਾ ਦੀ ਸਖਤ ਮਨਾਹੀ ਹੈ l

(3)ਹਰ ਇਕ ਟੀਮ ਦਿੱਤੇ ਹੋਏ ਟਾਈਮ ਉਪਰ ਪਹੁੰਚਣੀ ਚਾਹੀਦੀ ਹੈ l ਅਗਰ ਟੀਮ ਦਸ ਮਿੰਟ ਲੇਟ ਹੋ ਜਾਂਦੀ ਹੈ ਤਾਂ ਸਕੀਰੈਚ ਕਰ ਦਿੱਤੀ ਜਾਵੇਗੀ l

(4) ਗੁਰੂ ਕਾ ਲੰਗਰ ਗੁਰੂਘਰਾਂ ਵਲੋਂ ਅਤੁਁਟ ਜਾਵੇਗਾ l

(5)ਰੈਫਰੀ ਦਾ ਫ਼ੈਸਲਾ ਅਟੱਲ ਹੋਵੇਗਾ l

(6) ਗਰਾਊਂਡ ਵਿਚ ਜਾਣ ਲਈ 10 ਪੌਂਡ ਫੀਸ ਹੋਵੇਗੀ l

(7) ਮੇਹਰਬਾਨੀ ਕਰਕੇ ਟਾਇਲਟਾਂ ਦੀ ਵਰਤੋਂ ਕੀਤੀ ਜਾਵੇ l ਗਲਤ ਵਰਤੋਂ ਵਾਲੇ ਨੂੰ ਬਾਹਰ ਕੱਢ ਦਿੱਤਾ ਜਾਵੇਗਾ l

(8) ਸਾਰੇ ਕਲੱਬ , ਟੀਮਾਂ ਦੇ ਖਿਡਾਰੀ ਅਤੇ ਪ੍ਰਬੰਧਕ ਟਿਕਟਾਂ ਖਰੀਦ ਕੇ ਆਉਣ। *ਇਹ ਟੂਰਨਾਮੈਂਟ ਇੰਗਲੈਂਡ ਕਬੱਡੀ ਫੈਡਰੇਸ਼ਨ ਦੇ ਅਸੂਲਾਂ ਮੁਤਾਬਕ ਹੋ ਰਿਹਾ ਹੈ l ਟੀਮਾਂ ਖਿਡਾਉਣ ਤੇ ਪ੍ਰਬੰਧ ਦੀ ਜ਼ਿੰਮੇਵਾਰੀ ਕਬੱਡੀ ਫੈਡਰੇਸ਼ਨ ਦੀ ਹੈ l

Three Clubs and their members suspended by Federation

Due to serious breach of Federation rules and regulations before the start of Leicester tournament Punjab United Wolverhampton, Sikh Temple Wolverhampton and Leicester have been suspended from being members of England Kabaddi Federation. As a result the 3 clubs' representatives on the Executive committee of the Federation namely Ranjit Singh Dhanda, Kulwant Singh Sangha and Sear Singh Auluck have also been suspended automatically. Due to the actions of these clubs and their members the Federation was forced to cancel Leicester tournament and disciplinary proceedings against all 3 clubs and their representatives have already begun. Further updates will follow as matters progress.
